2. Purpose and acceptance
This Legal Notice governs access to, navigation of and use of the website d-liniex.com (hereinafter, «the Site»). Browsing the Site confers the status of User and entails full and unreserved acceptance of the provisions contained herein, as well as, where applicable, of the Privacy Policy and the Cookies Policy, which form an integral part of this Legal Notice. The User declares that they are of legal age and have the capacity to enter into contracts.
3. Pre-contractual information (art. 27 LSSI-CE)
For the services and subscriptions available for contracting through the Site, the User is informed of: (i) the contracting procedures (selection, registration, express acceptance of the General Terms and Conditions, verification and confirmation); (ii) the filing of the electronic contract, accessible upon request at info@d-liniex.com; (iii) the technical means for correcting errors before confirmation; (iv) the language of the contract (Spanish); and (v) General Terms and Conditions of Contracting that are accessible, printable and downloadable in advance.
4. Disclaimer of liability
4.1. Regarding verifications carried out with artificial intelligence
D-LINIEX makes available regulatory-compliance verification tools based on artificial intelligence (hereinafter, «the AI» or «the Verifier»). The underlying natural-language processing and semantic-search services are provided by specialised external providers, with partial processing in the USA. The associated international transfers are governed by the safeguards set out in detail in the Privacy Policy.
- The reports generated by the AI are merely indicative and intended as support for the competent technician and DO NOT replace, under any circumstances, the professional review, supervision and validation by a qualified, registered technician.
- The AI may incur errors, omissions, inaccuracies or incorrect interpretations of the applicable regulations, especially in complex or atypical projects or those requiring qualified professional judgement.
- The User assumes the obligation to review, check and supervise every report issued by the AI before applying, signing, endorsing (visado) or submitting it to any body.
- D-LINIEX shall not be liable for any damages, losses, administrative penalties or claims arising from the use of the report without appropriate professional supervision.
- Ultimate responsibility for the project’s conformity with the applicable regulations always lies with the signing technician, pursuant to Article 17 of Law 38/1999, of 5 November, on Building Regulation (LOE).
4.2. Regarding the projects uploaded to the AI Verifier and the project panel
When the User uploads technical project documentation (reports, drawings, quantities, annexes, BIM models, graphic documentation or any other file), they declare and warrant, under their sole responsibility: (i) that they hold the intellectual and industrial property rights over the documentation or have the holder’s authorisation; (ii) that they have a valid legal basis (art. 6 GDPR) to provide the personal data of third parties that the documentation may contain (developer, owners, technicians, neighbours, etc.) and have complied with the information duties of arts. 13 and 14 GDPR; and (iii) that they have adopted reasonable minimisation precautions.
D-LINIEX will process the documentation solely in order to issue the requested report or service and will under no circumstances use the content provided by the User to train, fine-tune, evaluate or improve artificial intelligence models, whether its own or those of third parties, except with the express, separate and informed authorisation of the User. This prohibition is contractually passed on to all sub-processors involved in providing the service.
The intellectual and industrial property rights over the uploaded documentation remain entirely with the User. D-LINIEX undertakes a duty of secrecy and confidentiality over all the documentation provided, even after the contractual relationship has ended.
4.3. Regarding the technical services provided
The deliverables produced by D-LINIEX’s technical team (draughtsmen, BIM modellers, structural engineers, quantity surveyors) are delivered as technical support to the end client, who is the party that signs, endorses (visa) and assumes responsibility for the resulting project. The end client must review, check and supervise all deliverables before signing or endorsing them. The civil, administrative, criminal and professional liability for the project lies entirely with the signing technician and the developer, pursuant to the LOE.
4.4. Regarding the site’s informational content
D-LINIEX endeavours to provide up-to-date and accurate information, but does not guarantee the absence of errors in the blog, technical data sheets or linked documentation. The User must always consult the official source (BOE, regional official gazettes, the CTE electronic office) before applying any information to a specific case.
5. Intellectual and industrial property
All content published on the Site is the property of PORRAS BARRIOS PROYECTOS Y SOLUCIONES, S.L. or of third parties who have authorised its use, and is protected by Royal Legislative Decree 1/1996, of 12 April (TRLPI) and Law 17/2001, of 7 December, on Trademarks. Its exploitation without the holder’s written authorisation is prohibited. The D-LINIEX brand is the property of PORRAS BARRIOS PROYECTOS Y SOLUCIONES, S.L.. Bitrix24 is a registered trademark of Bitrix Inc. and is used under the official partnership agreement.
6. Operation of the Site and links
D-LINIEX does not guarantee the uninterrupted availability of the Site or of the cloud functionalities (AI Verifier, project panel, integrations). It shall not be liable for damages arising from interference, viruses, breakdowns, disconnections or blocks due to causes beyond its control. The Site may contain links to third-party sites, for whose content D-LINIEX assumes no responsibility.
7. Obligations of the User
- Not to use the Site for unlawful purposes or purposes harmful to the rights of third parties.
- Not to introduce viruses, malicious code or harmful elements.
- Not to carry out scraping, reverse engineering or attempts at unauthorised access to the Site’s systems, AI models, databases or deliverables.
- Not to impersonate identities or use the credentials of others.
- To safeguard access credentials and to report any unauthorised use immediately.
8. Processing of personal data
The processing of the personal data collected through the Site is governed by the Privacy Policy, which complies with the provisions of Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, of 5 December (LOPDGDD). The use of cookies is governed by the Cookies Policy in accordance with art. 22.2 LSSI-CE and the AEPD Guidance of July 2023.
9. Amendments, partial invalidity and jurisdiction
D-LINIEX reserves the right to amend this Legal Notice, publishing the updated version with an indication of the date. If a clause is declared null and void by a final decision, the remaining clauses shall remain in force and the affected clause shall be replaced by the one that most closely approximates its purpose.
This Legal Notice is governed by Spanish law. For the resolution of disputes:
- Where the User has the status of consumer (art. 3 TRLGDCU), the Courts and Tribunals of the consumer’s domicile shall have jurisdiction (art. 90.2 TRLGDCU). Likewise, the User may resort to the European Commission’s ODR Platform (ec.europa.eu/consumers/odr), in accordance with Regulation (EU) No 524/2013.
- Where the User does not have the status of consumer, the parties submit to the Courts and Tribunals of the city of Cáceres, expressly waiving any other jurisdiction.
