New RSCIEI v2 Technical Guide (June 2026)

Spain's Ministry of Industry and Tourism has published version 2 (June 2026) of the Technical Guide to the Fire Safety Regulation for Industrial Establishments (RSCIEI, Royal Decree 164/2025) — the national code governing fire safety in industrial buildings. This update expands and clarifies the regulation that came into force in May 2025.

Legal status: the technical guide is interpretative. It is not legally binding in the way RD 164/2025 itself is, but because it is issued by the competent Ministry, it constitutes the official interpretation of the regulation and carries significant practical weight — control bodies, inspectors and the administration treat it as mandatory reference. Ignoring it means taking on unnecessary technical and professional risk.

What's new in version 2?

The guide adds interpretative criteria and practical clarifications, in shaded boxes that complement the text of RD 164/2025. Six main changes stand out:

1. Existing establishments

As a general rule, the new RSCIEI does not require existing facilities to be retrofitted to the new requirements, except for matters relating to operation and maintenance of installations, periodic inspections, fire-response procedures and the penalty regime.

2. Periodic inspections

The new inspection intervals apply from 10 November 2025. For facilities predating the 2004 RSCIEI, the guide sets a transitional regime with a deadline of 10 November 2030 in certain cases.

3. Refurbishments, extensions and changes of use

The regulation applies when built surface area increases, the intrinsic risk level rises, or a change of use means the facility no longer matches its registered project. As a general rule, the new requirements only affect the part subject to the works.

4. Project vs. technical report

The guide specifies the cases in which a full project can be replaced by a technical report for smaller-scale facilities, simplifying the administrative process.

5. Control bodies (OC)

The guide clearly distinguishes the functions and accreditations of control bodies (organismos de control) in inspecting and evaluating projects, separating competencies under RSCIEI from those under RIPCI (the fire-protection installations regulation).

6. Special-risk zones

New specific criteria are introduced for: tall metal racking, mezzanine floors, textile structures, specific storage types, cold stores, and installations located on rooftops.
